Jonathan Ross, the ICE agent who shot Good three times in the head, was captured on video from multiple angles, including footage he filmed himself. The prosecution already has extensive witness testimony from the scene and video documentation of the entire incident.
Despite concerns that the FBI and DOJ are hindering the case by refusing to share evidence with local authorities, the reality is that Minnesota prosecutors likely have more than enough to secure a grand jury indictment and conviction. The burden of proof for a grand jury indictment is low, and when a crime is this severe and well-documented, physical evidence becomes less critical. Murder convictions have been secured with far less evidence, often relying entirely on circumstantial evidence and witness testimony.
The Trump administration's strategy to protect Jonathan Ross by withholding evidence from Mary Moriarty and Minnesota state officials could actually increase the likelihood of conviction. When Minneapolis jurors learn that their federal government refused to cooperate with local prosecutors investigating a murder in their community, that anger will likely influence their verdict. The community has already been negatively impacted by federal overreach, and a jury of Minneapolis residents may not respond favorably to the DOJ and FBI blocking their own state's investigation.
Grand juries across the country have already demonstrated their willingness to push back against this administration's actions. The same prosecutorial approach that struggled to indict protesters in Washington DC will face a very different reception in Minneapolis, where the victim was a mother of three shot by a federal agent. The incompetence of Kristi Noem, Pam Bondi, Kash Patel, and others in handling this situation may seal Jonathan Ross's fate rather than save him.
