After the attack, the victim suffered a fractured skull and brain hemorrhage. Bui Van Phu, 55, was initially charged with attempted murder. Despite the video that showed the attack, prosecutors reduced the charge to the third-degree assault, which is a misdemeanor. Phu is also a registered sex offender on lifetime parole for a 1995 sexual assault.
