Protesters climbed onto the New York City subway tracks over Jordan Neely's death. Neely was killed after U.S. Marine veteran Daniel Penny put him in a chokehold. In a statement, Penny's attorneys say "Daniel, with the help of others, acted to protect themselves until help arrived. Daniel never intended to harm Mr. Neely and could not have foreseen his untimely death.” However, Neely's family is calling the statement a "character assassination."
