This clip from a recent episode of Focal Point aired on Oct. 31. prior to a jury acquitting Marine veteran Daniel Penny from charges related to the death of Jordan Neely on a New York City subway.

Last year, Penny placed Neely in a chokehold after he began yelling, threatening passengers, and saying he was ready to kill someone in a crowded New York City subway car. A bystander filmed Penny holding Neely in chokehold until after he appeared to lose consciousness.

NYPD officers arrived and said Neely had a faint pulse, and was given Narcan and CPR on the scene. He was transported to a hospital where he was pronounced dead. His death was ruled a homicide by compression of the neck. Neely was homeless and reportedly battled mental illness.

Neely had an extensive criminal record, including 42 arrests on charges including petty larceny, jumping subway turnstiles, theft, and three unprovoked assaults on women in the subway between 2019 and 2021.

Penny faced up to 19 years in prison if convicted.
