Judge James Ho of the 5th U.S. Circuit Court of Appeals wrote an opinion arguing doctors suffer an "aesthetic injury from the destruction of unborn life." He attempted to illustrate standing by comparing the FDA's approval of mifepristone to pesticide use or land development that prevents people from enjoying the appearance of living animals, arguing that this is similar to the experience doctors have when they can no longer see the unborn in their work.
