A leaked internal ICE memo reveals the agency is now asserting sweeping power to forcibly enter homes

without a judge’s warrant—a direct violation of Fourth Amendment protections and decades of Supreme

Court precedent. Former federal prosecutor Glenn Kirschner and former Florida state attorney Dave

Kirschner explains how the policy violates two critical Supreme Court cases: Payton v. New York (1980),

which prohibits warrantless home entries for arrests, and Camara v. Municipal Court (1967), which

clarifies that administrative warrants cannot authorize home entries without consent. “The Trump

administration is basically saying we don’t care. We’re intending to do it anyway, and I dare anybody to

try to stop us,” Kirschner warns. The memo was kept secret—verbally briefed to agents rather than

distributed on paper—until a whistleblower leaked it to the Associated Press. There were reportedly

resignations from DHS officials who refused to participate in what they knew was unconstitutional.

This isn’t just about immigration enforcement. Once the government claims power to enter homes without

judicial warrants, that authority can expand across all federal agencies. As Aronberg emphasizes, “The

Fourth Amendment applies to citizens and non-citizens alike.” This is part of a broader pattern of ICE

operating with impunity: killing Renee Good without investigation, detaining a 5-year-old as bait, and now

claiming the right to enter your home without a judge’s approval. Both prosecutors believe courts will

strike this down—but only if someone challenges it.
