New Jersey police noticed a vehicle that was failing to maintain control in its lane and tailgating the car in front of it. Officers then initiated a traffic stop and quickly detected the odor of alcohol coming from the driver, Isabel Montes. When the officers asked her to perform field sobriety tests, she failed to recite the alphabet correctly and stumbled through both the one-leg test and the walk-and-turn test. Montes was then arrested at the scene and claimed that the officers arrested her because of her race.
