Closing Arguments
Question 1: What is the purpose of the financial question for count two and count three that follows the if "guilty" verdict listing. Judge's Answer: Answer the question Only if you find the defendant guilty. Any purpose of doing so are matters for the court alone to Decide.
Question 2: May we please have exhibit number 98, 118, 117, 134, 7 through 21, 31 23 through 32? Judge's Answer: See attached. "All exhibits are attached. All requested exhibits."

Question 4: May we please have a definition and elaboration on the term "practically certain" listed in the second element under count one and, of course, count one being the homicide charge. Two elements that have to be proven, are one the defendant caused the death of Lynn Hernan. There's a definition of cause that's provided right in the jury instruction. And then the second element is the defendant acted with the intent to kill Lynn Hernan. There's a definition of intent to kill. But it's that definition that includes the phrase Or was aware that her conduct was practically certain to cause the death of another human beings? Judge's Answer: The jury must rely upon the definition of the elements of the crime that has already been provided to them. No further definition. Uh, or explanation of practically certain will be provided to them.
Jury Request: Jury now requesting exhibits to review: lab report, demonstrative exhibit using handwriting analyst, another item from the handwriting evidence, more portions of the handwriting evidence. Judge's Reply: 64 is not an exhibit. All other exhibits are attached.
