Florida law doesn't really make a distinction about who can be held liable for the injuries or death to a motorcycle operator or a passenger. What Florida law does say is that anyone who is liable can be held responsible. So that could include potentially, the driver of another vehicle, the owner of a vehicle, certain corporations or commercial entities that have used or allowed the use of their vehicle in commerce. In addition, there's a possibility that the roadway may be liable and that could be either a public roadway or a private roadway.
The reality is, until you've spoken to an attorney, it's very difficult to determine who is liable for an injury or death to a motorcyclist or their passenger.
