The Florida Wrongful Death Act does not limit the amount of damages you can recover. In other words, if a claim is brought pursuant to the Wrongful Death Act, the individuals that bring that claim have the right to bring whatever damages the person who passed away could have brought against a defendant for themselves, in other words, past medical bills, future medical bills, lost wages, lost ability to earn and things called derivative suits. For example, loss of consortium and the ability of a family to bring a claim for the loss of a parent or child on behalf of the family.
