Brian Kabateck and Shant Karnikian unpack Senator Mark Kelly's 46-page lawsuit against Pete Hegseth for unconstitutional retaliation. Brian details Kelly's distinguished service: 39 combat missions, four space shuttle flights, Distinguished Superior Service Medal, Legion of Merit, Distinguished Flying Cross, and multiple NASA medals. Kelly retired as Navy captain (equivalent to Army full colonel) and is married to Gabby Giffords, the former congresswoman shot in politically motivated violence. The lawsuit names Hegseth, the Defense Department, Secretary of the Navy John Phelan, and the Navy Department. In November 2025, Kelly and other members of Congress released a video reminding service members they have a legal obligation to refuse unlawful orders—a longstanding, non-controversial military doctrine. Trump branded this "sedition" and retweeted someone saying they should be hanged. The complaint includes screenshots showing Trump personally writing "seditious behavior, punishable by DEATH!" Hegseth issued a censure letter claiming Kelly's statements undermine the chain of command and constitute conduct unbecoming an officer. Hegseth initiated proceedings to reduce Kelly's retirement rank and pay nearly 15 years after retirement, threatening court-martial. Kelly alleges four violations: First Amendment (punishing protected political speech), Speech and Debate Clause, separation of powers (targeting a lawmaker for disagreeing with the executive), and retaliation. Brian notes the supreme irony: Hegseth himself said in 2016 on Fox News "the military's not gonna follow illegal orders" when discussing Trump potentially giving illegal orders. Kelly's complaint quotes Hegseth's 2016 statements showing the hypocrisy. Legal experts say there's no legal basis for demoting Kelly for post-retirement political speech—misconduct must occur while on active duty, not 15 years later. Experts call Hegseth's attempt "dead on arrival" and "patently politically motivated."
