18:46Now PlayingAttorneys Brian Kabateck and Shant Karnikian are joined by civil rights attorney Greg Kirakosian to examine the case of Ruben Ray Martinez, a 23-year-old U.S. citizen fatally shot by an ICE agent on South Padre Island, Texas, on March 15, 2025 — his birthday. Martinez and his friend Joshua Orta were driving through an intersection where ICE agents were directing traffic after an unrelated car accident when agents opened fire. DHS claims Martinez intentionally struck an agent; Orta's account says they were nearly stopped and an agent fired seven shots through the window at close range. No body cameras. No dashcam released. ICE's involvement wasn't disclosed for 11 months — the case only surfaced after internal records were obtained through a FOIA request by Newsweek. Then the sole eyewitness, Orta, died in a fiery single-car crash four days before he was set to testify before a grand jury. Without him, the grand jury returned no indictment. Martinez's mother is a Trump voter. The family has been stonewalled for a year. The DOJ refused to investigate. A Texas state rep has invoked a new legislative rule to compel a public hearing.
