Trump DOJ BLASTED in 81-PAGE BLISTERING RULING

Attorneys Brian Kabateck and Shant Karnikian break down Judge Brian Murphy's 81-page ruling striking down the Trump administration's third-country deportation policy as unconstitutional. The policy allowed ICE to deport immigrants — without notice or any chance to object — to countries they have no connection to, including Rwanda, Eswatini, South Sudan, and Djibouti. The judge found it violates due process under the Fifth Amendment, federal immigration statutes that require a specific order of countries for removal, and the Convention Against Torture. The administration had argued that generic diplomatic "assurances" from receiving countries were sufficient — and that deportations were fine as long as nobody was "standing there waiting to shoot" the deportee upon arrival. The judge's response: "It's not fine, nor is it legal." He also documented government misconduct, noting the court was given false information twice and that the administration "repeatedly violated, or attempted to violate" his orders. The ruling requires meaningful notice before removal and a chance to contest deportation to any third country. The administration had already spent $32 million in taxpayer funds to convince third countries to accept roughly 300 deportees. The judge's closing line: "The Constitution recognizes higher values than speed and efficiency."
