The problem: multiple outlets — including Axios, CBS News, the Washington Post, the New York Times, Reuters, and an Israeli news channel — all reported the story within hours of each other, making Trump's claim that one reporter at one outlet was responsible completely hollow. Brian and Shant walk through why the First Amendment makes Trump's threat a nonstarter — from the 1971 Pentagon Papers ruling establishing that prior restraint requires proof of grave, immediate harm, to the Bartnicki v. Vopper decision holding that reporters can't be punished for receiving information that may have been illegally obtained by someone else. News gathering is constitutionally protected activity, and threatening reporters with jail for doing their jobs is a form of generalized prior restraint with a chilling effect on the entire press. The National Press Club called it "a direct threat to the First Amendment and the core function of a free press."
