Bush appointee who previously served on the Foreign Intelligence Surveillance Court — found the data collection was rolled out in a "rushed and chaotic manner" that "epitomizes arbitrary and capricious agency action." The administration wrapped the demand in the 2023 Supreme Court decision banning race-conscious admissions, claiming it needed the data to ensure compliance. But Brian and Shant argue the real goal is to build cases against universities for being too diverse — redefining "racist" to mean providing opportunities for historically marginalized communities. The irony: the party of small government and individual privacy is demanding that colleges reconstruct datasets going back seven years, while simultaneously gutting the Department of Education and leaving almost no staff to process the information. Over 100 private universities have since joined the lawsuit, and the Association of American Universities is seeking to intervene.
