Attorneys Brian Kabateck and Shant Karnikian break down the DOJ's second indictment of former FBI Director James Comey — this time for posting a photo of seashells arranged to spell "86 47" on Instagram during a North Carolina beach vacation. Acting Attorney General Todd Blanche, Trump's former personal lawyer desperate to prove himself after Pam Bondi was fired, charged Comey with threatening the president and transmitting a threat in interstate commerce, claiming a "reasonable person" would interpret it as a death threat. Brian and Shant explain that "86" is a term from the restaurant and bar industry meaning to remove or get rid of someone — not kill them. There is no documented history of "86" being used as code for violence. Comey deleted the post and said he didn't realize some people associated the numbers with violence. His lawyer, Patrick Fitzgerald, plans to file a motion to dismiss on grounds of vindictive prosecution. Legal experts called the case "shellshocked" — one former U.S. Attorney told NBC the post is "not him saying, 'I am going to kill him.'" Meanwhile, on the same day, a federal judge allowed a retaliation lawsuit by Comey's daughter, Maureen — a decorated prosecutor who led the Diddy, Epstein, and Maxwell cases — to go forward after she was fired from the DOJ for the sole reason of being James Comey's daughter. Brian and Shant predict the indictment has a shelf life of about five minutes.
