The dinner came just hours before the court released a 6-3 decision weakening the Voting Rights Act and on the eve of oral arguments over Trump's termination of temporary protected status for immigrants. The guest list of roughly 130 people included Fox News hosts, tech billionaires, Cabinet secretaries, and Palm Beach friends — but not a single Democrat. Georgetown Law professor Steve Vladeck said the symbolism "does nothing to disabuse the appearance that the court is playing partisan political favorites." Brian and Shant note the stunning hypocrisy: just days earlier, Trump called Roberts, Gorsuch, and Barrett "an embarrassment to their families" and "weak, stupid, and bad" for ruling against his tariffs — and they still showed up. Chief Justice Roberts has publicly stated "we do not sit on opposite sides of an aisle" and Barrett has insisted the court is "not a bunch of partisan hacks." Brian and Shant walk through the court's 2023 ethics code and explain why it arguably advises against attending such events, but note that unlike lower court judges, Supreme Court justices have no enforceable ethics rules — which is exactly why Congress needs to act.
