as posted by the channelAttorneys Brian Kabateck and Shant Karnikian break down what The New Republic called "the characteristic mix of fecklessness and contempt" from ICE in a Rhode Island case. U.S. District Judge Melissa DuBose ordered the release of Bryan Rafael Gomez after finding his detention under a border arrival statute was unlawful. What DuBose didn't know was that Gomez had a 2023 Dominican Republic homicide warrant, because ICE specifically instructed Assistant U.S. Attorney Kevin Bolan not to disclose it. Two days later, DHS issued a press release titled "Activist Biden Judge Releases Violent Criminal Illegal Alien Wanted for Murder," accusing DuBose of releasing a killer she knew was dangerous. The U.S. Attorney's Office confirmed that was false: DuBose had no idea about the warrant when she ruled. Even Gomez's own defense attorney said she would never have filed the habeas petition if she had known. Bolan apologized in court and admitted ICE told him to neither confirm nor deny the warrant. A DHS official filed a declaration confirming this was "consistent with ICE policy and practices." DuBose referred the matter for a full disciplinary investigation, calling it a "massive breach" of the trust between the court and the government.
