Attorneys Brian Kabateck and Shant Karnikian cover the double blow that landed on Trump's anti-weaponization fund in a single Friday. Judge Kathleen Williams in Florida reopened the IRS lawsuit she had just dismissed, ordering Trump's lawyers to respond by June 12 to "grievous allegations" that the settlement was "premised on deception." The move came after 35 former federal judges, appointed by presidents of both parties, filed a motion calling the lawsuit "itself a fraud on the court" and arguing it was used to justify "looting" American taxpayers. Separately, Judge Leonie Brinkema in Virginia issued a temporary restraining order freezing the fund entirely, blocking the DOJ from reviewing claims or disbursing any money "to ensure that no funds are irreversibly disbursed." Brian and Shant explain the fraud on the court doctrine: courts retain inherent power to reopen cases when dismissals are obtained through collusion or deception. The threshold problem is that Trump was simultaneously the plaintiff suing the IRS and the executive who controls it. No settlement was ever referenced in the dismissal papers. The $1.776 billion fund and the separate addendum granting Trump permanent audit immunity have nothing to do with the underlying case about leaked tax returns. Todd Blanche and Stanley Woodward, the DOJ officials who signed the agreements, could face hard questions. Brian, who has been appointed by judges in the past to investigate fraud on the court, says this is textbook collusion.
