Attorneys Brian Kabateck and Shant Karnikian cover the slow-motion collapse of Trump's $10 billion defamation lawsuit against the BBC over a 12-second edit of his January 6 speech. The BBC, which Trump can't regulate because it's a foreign public broadcaster, refused to bend the knee. Instead, it issued 47 subpoenas to people in Trump's orbit, including family members, Steve Bannon, and financial entities, seeking discovery on three fronts: how a BBC documentary actually harmed his reputation (he won the 2024 election after it aired), what really happened on January 6, and Trump's financial records to test his damages claims. Meanwhile, Trump's lawyers missed the June 5 deadline to respond to the BBC's motion to dismiss. Judge Roy Altman ordered them to explain their "apparent disregard of court deadlines" and warned of sanctions. Their excuse: Trump is busy and needs to review deposition transcripts. Brian and Shant, who handle litigation daily, call this potential malpractice in any normal case. The BBC's defenses are stacking up: no personal jurisdiction in Florida, no broadcast in the United States, no actual malice, and no damages given the 2024 election win. Brian predicts Trump is looking for a graceful exit.
