8:26Now PlayingAttorneys Brian Kabateck and Shant Karnikian cover the Supreme Court's twin rulings on presidential removal power. In Trump v. Cook, a 5-4 majority blocked Trump from firing Fed Governor Lisa Cook, finding the administration failed to provide due process before attempting removal. The Federal Reserve's "distinct historical tradition" and quasi-private structure earned it special protection. Justice Kavanaugh, a Trump appointee, told Solicitor General Sauer during oral argument: "What goes around comes around. All the current president's appointees would likely be removed for cause on January 20, 2029." In the companion Slaughter case, a 6-3 majority went the other direction, ruling that the president can fire heads of other independent agencies like the FTC without cause, effectively gutting Humphrey's Executor for all agencies except the Fed. Brian calls Slaughter "terrible" and Cook "makes some sense." But both Brian and Shant stress the goose and gander rule: every tool Trump just gained, a future Democratic president inherits. Trump is framing Cook as a win because the court left the door open for further proceedings, but Brian predicts TACO: Trump Always Chickens Out. He'll never prove mortgage fraud.
