11:33Now PlayingAttorneys Brian Kabateck and Shant Karnikian cover the firing of Roger Rogoff, a 20-year state prosecutor, six-year federal prosecutor, and former judge, who lasted less than an hour as U.S. Attorney for the Western District of Washington. All 17 active and senior judges in the district, appointed by five different presidents, unanimously selected Rogoff under Section 546(d) after Trump's interim pick Charles Neal Floyd overstayed his 120-day statutory limit. Rogoff was sworn in before 8 a.m., walked to the U.S. Attorney's office, and received his termination email while waiting in the lobby. Acting AG Todd Blanche posted on X: "District court judges can appoint a temporary U.S. Attorney, and POTUS can fire them." Brian compares the title shuffling to Sam "Ace" Rothstein in Casino, where Floyd keeps getting new titles to stay in the job: interim U.S. Attorney became "First Assistant U.S. Attorney" when his 120 days expired. The statutory conflict is real: 546(d) says judges can appoint when the interim term expires, but the administration argues Article II gives the president removal authority over all U.S. attorneys. Rogoff is consulting lawyers about a legal challenge. Only 31 of roughly 62 U.S. Attorney positions nationwide have Senate-confirmed prosecutors. Sen. Patty Murray called Floyd "an out-of-touch extremist" and said the administration "just wants to install cronies."
