11:03Now PlayingAttorneys Brian Kabateck and Shant Karnikian break down a bombshell Associated Press investigation revealing the Trump administration has detained more than 50 parents and spouses of active-duty U.S. service members since January 2025, with at least six already deported and one self-deported. For decades, a 2022 Department of Homeland Security memorandum treated a service member's active-duty status as a significant mitigating factor against deporting their spouse or parent — a bipartisan policy this administration has unilaterally rescinded. Brian and Shant walk through case after case: Annie Ramos, newly married to Staff Sergeant Matthew Blank, detained at a military base while picking up her military spouse ID; Daisy Rivera Ortega, wife of a 28-year Army veteran, detained at a routine immigration check-in she showed up to voluntarily; and Maisa Lopez Elizar, whose husband had to take administrative leave to care for their child after ICE detained her. None of the cases involve violent crime — at most, some minor misdemeanors. Brian and Shant also flag a likely Administrative Procedure Act challenge, since DHS scrapped the longstanding mitigating-factor policy with no hearing, no notice, and no explanation. Brian's bottom line: an administration that plasters "support the troops" on every recruiting billboard is deporting the very military spouses and family members holding those troops' households together while they're deployed.
