The indictment against former FBI Director James Comey is collapsing under its own weight. What was billed as a historic prosecution now looks more like a botched political stunt, doomed from the start. At the heart of the case is the allegation that Comey lied under oath about whether he authorized his deputy, Andrew McCabe, to leak investigative information to the Wall Street Journal. But here’s the fatal flaw — McCabe never actually claimed Comey authorized him. He claimed he acted on his own and told Comey afterward. That is not authorization in any legal or common-sense meaning of the word.

Perjury requires precision. A clear question, a clear false answer, and proof beyond a reasonable doubt. None of those conditions exist here. Comey may deserve criticism for his disastrous leadership of the FBI. He may have earned the contempt of millions of Americans. But justice is not about payback, it is about evidence. On that score, this indictment fails miserably. The law is clear, the facts are absent, and the only proper outcome is dismissal.
