Jocelyn Nungaray murder: Bail for both suspects set at $10M | LiveNOW from FOX

A second Venezuelan man living in the U.S. illegally and accused of killing a 12-year-old Houston girl was ordered on Tuesday to be held on a $10 million bond. Johan Jose Martinez-Rangel, 22, is one of two men charged with capital murder in Jocelyn Nungaray's death.

Martinez-Rangel's court appearance comes one day after the initial appearance of his roommate and fellow suspect, Franklin Pena. According to the lead prosecutor, Pena and Martinez-Rangel met each other when they were both on their way to the United States from Venezuela and then later connected in Houston.

Harris County District Attorney Kim Ogg told Fox News that it was likely a sexual assault happened. A kit has been made, but the results are still pending.

Both suspects are charged with capital murder. The judge set bond at $10 million. The State had requested a $5 million bond, while the defense asked for $1 million. The state presented evidence indicating that one of the suspects, who works in construction, requested money from his boss to leave town following the incident.

The details of Nungaray's death are disturbing. She was found in a bayou in north Harris County, Texas, in the early morning hours of June 17. Her hands and feet were bound and she was nude from the waist down, according to authorities. Jocelyn also had marks on her neck and scrapes on her back consistent with being dragged. The autopsy confirmed the cause of death as strangulation.

According to court proceedings, surveillance cameras captured two individuals leaving the bayou at 3:04 a.m. Two days after Jocelyn's body was found, Pena called his boss at a construction company, stating that he and Martinez did something bad after partying, leading to someone’s death. Pena claimed that he and Martinez were with Jocelyn to a bridge where he allegedly kissed Jocelyn before Martinez assaulted her. Pena stated that Martinez strangled her. Martinez admitted to authorities that he tied Jocelyn's legs and instructed Pena to throw her in the bayou. Martinez had bite marks and scratches on his arm. Pena's body also had scratch marks.

Bail was set at $10 million for both suspects, citing the severity of the charges and flight risk. DA Ogg said neither suspect currently faces the death penalty, but that could change if further evidence, such as kidnapping or sexual assault, is confirmed.

"It’s especially difficult when it’s a loss of a 12-year-old child who had their whole life ahead of them. So, this will be an emotional case for us as prosecutors as well as the family," the lead prosecutor, said.
