3:45Now PlayingKilmar Abrego Garcia has been released from an immigration detention center in Pennsylvania following an order from a federal judge issued Thursday, according to his attorney’s office.
"Since Abrego Garcia’s return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," U.S. District Judge Paula Xinis said in her order.
Abrego Garcia, who lives in Maryland, was wrongfully deported to El Salvador and sent to a notorious prison back in march in violation of a 2019 court order and was later brought back to the U.S. After it made national headlines and became a flashpoint of the trump administration’s immigration crackdown.
The Trump administration acknowledged his deportation was an ‘administrative order, but when he returned to the U.S., Abrego Garcia was detained again by federal authorities on human smuggling charges related to a 2022 traffic stop.
White House press secretary Karoline Leavitt told reporters Thursday afternoon that the administration would ‘absolutely’ be appealing the order.
A hearing on the motion to dismiss Abrego Garcia’s charges has been scheduled for early January.
