The Chud The Builder situation has sparked a lot of debate online, but many people are framing it as a First Amendment issue when it simply is not.
The First Amendment protects citizens from government restrictions on speech. As of now, the charges being discussed are not related to what Chud said, his opinions, his political views, or his ability to express himself. The government is not charging him for speech.
The real legal question is whether he was acting within the law when he chose to fire his gun.
Too often, people jump straight to political talking points instead of examining the facts of a case. Whether you support Chud or not, understanding the distinction between constitutional rights and self-defense claims is critical.
What do you think? Is this being incorrectly framed as a free speech issue, or is there something people are missing?
