Hip-hop mogul Sean “Diddy” Combs might be out of prison much sooner than expected. After serving 12 months behind bars, his legal team is asking a federal judge to release him with time served.

Diddy was convicted this summer on charges of transporting women for prostitution, a crime that carries up to 10 years. But he dodged the biggest charges: sex trafficking, racketeering, and an individual RICO count. Now, his lawyers argue he’s faced enough punishment in one of the toughest jails in America, and that it’s time to move on.

Judge’s decision comes October 3rd. If approved, Diddy could be home before Halloween. If not, he’s looking at nearly a decade in prison.

Marc Lamont Hill breaks down the legal fight, the morality of sentencing, and the bigger question: does time served really fit the crime?
