But 11 years ago, if I sang Happy Birthday to a fan and posted it on YouTube (in exchange for a generous donation to the mikeroweWORKS Foundation), the answer was “Absolutely!” That was back before a court finally came to its senses and determined that Warner Chappell Music had no legal right to charge a license fee every time the song was sung in public. In fact, that same court ordered Warner Chappell Music to return $14 million in licensing fees they’d improperly collected. That’s when Happy Birthday finally entered the public domain. Before that, however, if a guy like me wanted to raise a few bucks for his foundation by singing Happy Birthday to a fan, he could not. Which is why I had no choice in those days but to open a beer, write an original song, and sing it as best I could.
