Question: I paid the final installment of my flat worth Rs 79 lakh to the builder on June 4, 2013. I didn't know I had to pay 1% TDS. I received a notice from the Tax Dept and paid the amount. I submitted Form 16B to the builder and requested the builder to refund the TDS. He refused to do so. How can I recover the amount?
Answer: Follow-up with the builder for refund of excess TDS payment. If any other payments are due to the builder, you may adjust this amount against such dues.
Otherwise, you may approach your assessing officer and the jurisdictional TDS officer of the builder to discuss this matter.
