Question: I am purchasing a property in Gurgaon where the seller has got the property basis a registered Will. Now the bank is insisting for probate of Will. So how much it is required.
Answer: The bank needs to understand the owner of the will. A will is a contestable document. Prima Facie, person who made the will has an intention to give it to someone.
A probate is basically an insurance you are asking for yourself. Try to insist the developer to handover the probate, after which you can hand it over to the SBI for home loan.
