Question: I purchased an apartment in Prestige Fern Residency, Bengaluru during the pre-launch stage in 2013. I want to sell it. It will be ready-to-move-in within 3 months. What is the procedure involved in selling an under-construction property? How can I collect payment from the buyer?
Answer: I assume you now have some kind of agreement. Generally, agreements in Karnataka are two-fold.
1) For constructing the flat for you

2)Transferring undivided interest in land.
Ensure both are in place properly stamped and registered. Next, confirm that there is no clause in the agreement preventing you from selling it at this stage. Tripartite agreements are not legal strictly speaking. Collect your consideration on or before signing and registration.
