Question: I'm looking for a property in Bengaluru and want to know what kind of approvals is required for a legal property? Also, how can we find out whether the property has all the approvals in place?
Answer: It is advisable to only buy a property after the state has implemented the real estate regulation and development Act, 2016 (RERA) which has already been gazetted on 26/03/2016. Once RERA is implemented, the developer cannot sell the flat or office unless and until all the approvals from the competent authority are received and uploaded on the website. In case you are in a hurry to buy a property then check the title document of the land, approved and sanctioned plan, the draft of the agreement to be executed etc. You can also file an application under RTI before the competent authorities and get all information with regards to whether the developer has the required IOD, commencement certificate, T.D.R etc.
