Expert: Anshuman Jagtap, Associate Partner at Hariani & Co.

Question: Within how much time should the managing committee of a society send AGM & SGM minutes to all the members? If this is not done, what punitive action can be initiated and by which authority? If the action is repeated for many years by the managing committee members, what can be done?

Answer: Under the bye laws, the draft minutes of every GBM must be circulated within 3 months from date of the meeting. Members have 15 days to communicate their observations within 15 days of circulation. At the subsequent meeting, committee shall prepare final minutes considering the observations and cause them to be recorded in the minute books. Registrar can hold enquiry and pass Order inter alia directing the Society to remedy the defect within 60 days. Complaint can be made by a member/s to Registrar under Bye law No. 175.
