Question: I bought a property at upper Juhu from the builder - it was going in for redevelopment. Redevelopment began at a good pace. Construction stopped later on. The building has stopped construction. My IT file went into scrutiny. IT dept. wants agreements. Asked IT dept. to give builder notice. IT refused to comply. He must pay 20% capital gains. Went for an appeal. Took a stay. IT dept. said they will give stay, but must pay 15% as capital gains. Till judgement comes you must pay, if it comes in his favour they will refund with interest. Builder refusing to pay him for this. Builder promised rent if it was delayed. Paid Rs 8 lakhs as the rent. No rent, no property, IT scrutiny. What to do?
Answer: You should get a lawyer to represent you. Get in touch with the I.T dept. Make a representation. Appeal to them asks them to consider your case. If not then approach the court against the I-T department.
