Question: How does calculation of capital gains tax differ for resident Indians and non-resident Indians? How can I claim capital gains exemption?

Answer: Non-residents cannot utilize basic exemption limit. Payment to resident sellers subject to TDS at 1% u/s 194IA of the act where sale consideration exceeds is R50 lakhs. Payment to non-resident sellers subject to TDS at the normal tax rates on the capital gain u/s 195 of the Act with no monetary threshold.
