Question: Our society has gone in for redevelopment without following any process. A show cause notice was given by MHADA to the society and the committee was dismissed for non-adherence of processes like transparent tender process, lack of indemnity bond etc. The new committee was appointed but the same builder was allowed to continue without a tender process by MHADA & the Society. The builder is not giving us our Corpus Fund for 6 years along with delayed interest till date. The builder has paid lower rent to us than others for 2 years. He also cheated us by taking our signature on individual agreement. It was signed in front of Police Officer, at police station & our lawyer. After 4 days he refused to give our agreement and money saying he has lost the agreement. The builder is harassing senior citizens when we are owners. 3 out of 4 senior citizens have died in the last 2 years. Can the builder take a stand that he has incurred a loss because we have vacated the houses late?
Answer: If you have not got the agreement or there are other lacunae, then you may approach the consumer forum for help. If loss has been caused to you, damages can certainly be claimed by you. You can also approach the city civil court.
