Question: I made an initial payment of Rs10 lakhs to a developer along with an associated service tax at 3.71% for booking an apartment in Mumbai in the year 2014. Subsequently, due to personal reasons, I had to cancel the booking in the same year. The developer returned the Rs10 lakhs paid by me, but not the service tax. Can I get a refund on service tax amount paid by me?
Answer: Service tax could be refunded if the agreement is cancelled and entire amount is refunded.
