Question: I booked a residential flat in Baroda. The cost of the flat was Rs 16,75,000. It is an under-construction property and the builder has promised me the possession in December 2016. I have made 90% payments to builder as per agreement. Now the builder is asking me to pay development charges in hard cash. He is not ready to accept cheque or issue any receipt for the service tax, vat tax and development charges. I have taken a home loan from SBI and now bank is asking me for the sale deed and mortgage papers. The bank has informed me that if I do not complete the formalities within one month then they will charge the penal interest. On the other hand, the builder is not ready to complete the formalities until I make the payment. What should I do?
Answer: You can approach the consumer court with a prayer seeking an order to compel the builder to execute the final document. You cannot be compelled to pay cash long as you and ready and willing to abide by the terms of the Agreement, the builder is obliged under law to execute and register the agreement.
