Question: I had booked a property with PRA realty named The Cove in Pune. Since the project got delayed, I asked the builder to cancel my booking and refund me the money. I was informed by PRA that they will refund in 60 days, but it’s yet to happen. On enquiring, the company is not giving satisfactory answer. What recourse should I take?
Answer: A consumer court is the better option for you for the simple reason that the project, wherein you have put in your money, is not getting worked out at all. If the status of the project is such that it can be shortly completed, then you can always say that you had given an offer for cancellation of booking but now that offer is over as the builder did not accept. Under that scenario, you can ask for possession within a stipulated time or alternatively ask for a proportionate market value.
