The order said that a brutal act of sexual assault on a woman by her husband is rape. "A man is a man; an act is an act; rape is a rape, be it performed by a man, the 'husband', on the woman, 'wife'," said Justice M. Nagaprasanna in response to the petitioner. The order by the Karnataka HC comes weeks after the Delhi high court had recently reserved its order on a bunch of petitioners, challenging the exemption to marital rape.
