3:47Now PlayingThe Supreme Court ruled that India should never turn into a "police state," where investigating agencies behave like relics of the Colonial era. The court urged the Union government to consider enacting a new law that would make it easier to grant bail and bring objectivity to the criminal justice system in order to prevent irrational arrests, particularly in situations where the maximum penalty for the alleged offence is up to seven years in prison.
A bench of Justices Sanjay Kishan Kaul and M.M. Sundresh noted that undertrial prisoners make up more than 2/3 of the prison population and that jails in India are overrun with them. Despite being charged with offences punishable by seven years or less and having a cognizable offence registered against them, it was stated that the majority of them might not even be required to be arrested.
