When hearing the petitions challenging the 2023 Amendment to IT Rules, which gives more power to the Centre for identifying fake news, the Court asked the Centre how can it be the arbiter of fake and false news. The Bombay High Court further questioned the necessity of the amendment to the Information Technology Rules, 2021, which introduced a government Fact Check Unit (FCU). The court raised this query as it found that the FCU lacked the authority to enforce the removal of content marked as false, fake, or misleading on social media platforms.
A panel of experts has joined Shreya Upadhyaya for a detailed discussion. SC Solicitor, Dr Kislay Panday, said “The govt is trying to act as an informant, judge & a victim at the same time. This is not the right way to execute this law, an independent body should be appointed for this amendment.”
