Comey Indictment Explained: Is “86” a Threat? | Misty Marris Breaks It Down

Misty Marris joins Hallie Jackson Now to break down the indictment of James Comey and the legal battle over whether a social media post using “86” qualifies as a criminal threat.

Marris explains what prosecutors must prove — including intent and whether the statement meets the legal definition of a “true threat.” She also outlines the defense argument that the phrase is ambiguous and protected under the First Amendment.

With questions around political speech, context, and intent, this case could test the limits of how courts interpret language in the digital age.
