as posted by the channelOn Wednesday, the Supreme Court heard United States v. Skrmetti. At issue in this case is whether or not the Tennessee law banning treatment for transgender minors is a distinction on the basis of sex. Tennessee says the law makes a distinction around medical purpose, not sex. But the challengers, including the families of trans teens and the federal government, say that the law does distinguish based on sex, and that it would therefore violate equal protection rules. “So if the court is simply saying that there's no sex based discrimination here, this is simply about medical purpose, biology, [or] biological purpose, then that opens the door to basically undermining the entire equal protection body of jurisprudence around sex based discrimination,” says MSNBC legal analyst and NYU Law professor Melissa Murray.
