Former S.C. Chief Justice Jean Toal is now presiding over the case, and has made several rulings affecting Alex Murdaugh’s bid. Toal has made it clear that Murdaugh's defense will have to prove that the alleged tampering affected the original trial's outcome, stating that, “Prejudice must be proved, not presumed.” Toal told the courtroom that she would not allow the upcoming evidentiary hearing to turn into a trial of Becky Hill. The judge says she intends to limit the witness list to the twelve deliberating jurors and #BeckyHill. What's more, Toal says she will be the one asking the questions.
