The legal precedent for birthright citizenship stretches back to a case involving a U.S.-born man named Wong Kim Ark.
In 1895, when Ark tried to return to the U.S. after visiting his family in China, he was denied reentry. Citing the Chinese Exclusion Act, which banned Chinese immigrants from becoming citizens, a U.S. customs agent told him he was not, in fact, a citizen of the United States.
Ark’s epic fight to be recognized as a citizen in his own country led to a Supreme Court decision affirming birthright citizenship.
