Many immigration lawyers who advise against mandamus for people who have been waiting years for an interview do it out of ignorance or insecurity. ✋ The sad reality is that many immigration lawyers know very little about asylum. When I worked as an asylum officer at USCIS, I was surprised to see how little many lawyers actually understood about the process. 😔 Another reason they usually reject mandamus is because they simply don’t know how to do it. Filing a mandamus lawsuit means going to federal court and dealing directly with the U.S. Attorney’s Office. That’s completely outside the comfort zone of most immigration lawyers, who have almost never dealt with a federal court. It feels intimidating, and instead of admitting they can’t do it, they tell the client it’s a bad idea.
