Winning asylum in the United States is hard. In Immigration Court, the approval rate is 19% based on the most recent statistics. We don’t know the current approval rate for affirmative asylum with USCIS because they haven’t released data in years, but I suspect it’s even lower—perhaps around 15%. So yes, it’s hard. But it’s not impossible. My law firm keeps winning cases for clients in both Immigration Court and the asylum office.
