We think there are strong arguments for why USCIS is still obligated to issue a decision when we bring a mandamus claim to move a stalled asylum case forward, even during the current pause on decisions. In other words, we believe we may be able to convince federal judges to disregard this temporary policy because the law requires a decision. We have several mandamus cases pending right now, so we’ll be making these arguments imminently. I’ll share updates as soon as we start getting rulings on this issue. Even if decisions can’t be forced during the pause, it still makes sense to push your case forward through mandamus. The sooner you get your interview, the better your chances for success, even if the decision itself takes longer due to the pause. And we can confirm that USCIS continues to schedule asylum interviews as a result of mandamus lawsuits despite the pause. Today we received an interview notice in our second case where we filed mandamus, and they issued the interview notice while the pause has been in effect.
